ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences under Sections 379 and 430 of IPC in Crime No.44 of 2017 and seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner is the owner of the vehicle which is alleged to have been involved in illegal transportation of sand.
3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.
4. The learned Government Advocate (Crl.side) submits that the petitioner, who is the owner of the vehicle has involved in transporting one unit of sand illegally.
5.Considering the facts and circumstances of the case and quantum of the sand involved, this Court is inclined to grant the relief of anticipatory bail to the petitioner.
6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Arcot, Vellore District, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation.
