Petitioner PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for records relating order dated 06.03.2015 passed in Crl.M.P.No.170 of 2015 in Crl.M.P.No.4949 of 2013 by the learned XVII Metropolitan Magistrate, Chennai and to set aside the same and consequentially allow the petition.

ORDER

This Criminal Original Petition has been filed challenging the order passed by the Court below in a petition filed under Section 31 of the Domestic Violence Act for eviction of the respondent from the dwelling unit.

2. The Court below has given a cogent reason for the dismissal of the petition and this Court does not find any ground to interfere with the same. That apart, this order was passed in the year 2015, and at this length of time no useful purpose will be served by interfering with the order and it is also informed that the criminal case itself is at the stage of final arguments.

3. In the result, this Criminal Original Petition is dismissed and the learned XVII Metropolitan Magistrate is https://hcservices.ecourts.gov.in/hcservices/

directed to dispose of the main domestic violence petition pending in M.P.No.4949 of 2013 within a period of one month from the date of receipt of a copy of this Order. If there is no Presiding Officer in the said Court, the in-charge Magistrate shall comply with this order. Consequently, connected miscellaneous petition is closed.
