JUDGMENT

(Delivered by M.M.SUNDRESH.,J) Challenging the order passed in I.A.No.260 of 2017 which has already worked out itself in view of the dismissal of F.C.O.P.No.149 of 2016, the present appeal is filed.

2. When the matter is taken up for hearing today, it is agreed by both the counsel that the order passed in I.A.No.260 of 2017 may be set aside, since the appellant is complying with the order passed in F.C.M.C.No.28 of 2015, and on condition that the appellant pays a sum of Rs.30,000/- to the respondent within a period of six weeks from the date of receipt of a copy of this judgment.

3. In view of the above said agreed terms, the order passed in I.A.No.260 of 2017 stands set aside subject to the condition indicated above.

Consequently, on such compliance, https://hcservices.ecourts.gov.in/hcservices/

F.C.O.P.No.149 of 2016 stands restored. The Family Court, Vellore, on such restoration, is directed to dispose of the same within a period of six months from the date of receipt of a copy of this judgment.

4. Accordingly, the Civil Miscellaneous Appeal stands allowed. No Costs.
