Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to accept the payment of interest as per the prevailing rate i.e., 7% from the petitioner and consequently direct them to close down the Jewel Loan Account No.71, based on the petitioner's representation dated 2.2.2017. ORDER

The petitioner, being a senior citizen and a permanent member of the Ernahalli Primary Agricultural Co-operative Credit Society for the past 40 years, had pledged his jewels and obtained a loan of Rs.1,00,000/- from the society on 6.2.2010. Due to severe drought and poor health, he was unable to repay the loan. Subsequently, in the year 2015, he had approached the respondent with a written request to regularise his jewel loan account No.71 and also expressed his willingness to settle the entire amount. But the respondent demanded a huge amount. As the petitioner is prepared to pay interest at the rate of seven percent per annum, a direction should be given to the respondent to consider his representation dated 2.2.2017.

In view of the limited request made by the petitioner, the respondent is directed to consider the pending representation of the petitioner on merits and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. The writ petition stands disposed of accordingly. No costs.
