.. Respondents Contempt Petition has been filed under Section 11 of the Contempt of Courts Act, 1971, praying to punish the respondents for the wilful disobedience of the order dated 10.02.2023 in Crl.O.P.No.3035 of 2023 on the file of this Hon'ble Court.

ORDER

This contempt petition is filed stating that the direction of this Court passed in Crl.O.P.No.3035 of 2023, dated 10.02.2023, was not complied with through letter and spirit.

2. The grievance of the petitioner is that as per the order of this Court, investigation ought to have been done by the Inspector of Police and the same should have been monitored by the Deputy Superintendent of Police contending that the final report been filed by the Sub Inspector of Police.

3. The learned counsel appearing for the petitioner states that there is violation of this Court order.

4. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that the final report is filed by the Sub Inspector of Police and the investigation was done by the Inspector of 2/4

Police and the cell phone of the petitioner herein, which alleged to have been stolen has been recovered from the third party and the same has been produced before the Magistrate and also the petitioner get back the cellphone by following the procedure established under law.

5. This Court accepts the explanation given by the learned Government Advocate (Crl.Side) appearing for the respondents. Hence, this Contempt Petition is closed.
