O R D E R
By consent, this Writ Petition is taken up and disposed of at the stage of admission itself.
2. This Writ Petition has been filed challenging the impugned order dated 13.02.2018 cancelling the order of appointment dated 18.01.2018 appointing the petitioner as Angawadi Helper / Assistant in Thandrampattu, Thiruvannamalai District.
3. The learned counsel appearing for the petitioner assailing the impugned order submitted that the petitioner has passed IX standard from Government Girls Higher Secondary School, Thaniyanpadi, Thiruvannamalai District and she was registered her name in Employment Office on 28.03.2014 for appointment in any one of Government or quasi Government Organisation. While so, the petitioner has applied for the post of Anganvadi Helper on 16.08.2017, pursuant to the Notification issued by the District Collector, Thiruvannamalai District. After participating in the selection process, she got 15 marks and she was also found eligible and accordingly, the second respondent has issued an order of appointment dated 18.01.2018 bearing No.Se.Mu.Na.Ka.No.1892/A1/2017.
On receipt of the Appointment Order, she has also joined duty as Anganvadi Helper / Assistant. When she reported for duty on 22.01.2018 at forenoon with all physical fitness certificate, the first respondent without giving any notice whatsoever terminated her service in the impugned order dated 13.02.2018, which was received by the petitioner only on 21.02.2018, citing a reason that the petitioner's husband is working in Government service and therefore, her appointment should be terminated.
4. The petitioner got 15 marks for the reason that no one in her family is employed in any Government service but admittedly the husband of the petitioner is employed as Cook in Adhi Dravida Welfare Officer. Therefore, the second respondent has wrongly awarded 15 marks to the petitioner. Hence, the reason given for recalling the Appointment Order cannot be found fault with. Accordingly, this Court, finding no error in the impugned order, is not inclined to grant the relief sought for by the petitioner. Accordingly, the Writ Petition fails and the same is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
5. The learned counsel appearing for the petitioner submitted that the petitioner has also filed an appeal before the Appellate Authority. No purpose is going to serve by directing the Appellate Authority to consider the matter and hence, this Court is inclined to dismiss the appeal also. -Sd/- Assistant Registrar // True Copy // Sub Assistant Registrar To 1.The District Collector, Collectorate, Thiruvannamalai District.
