Originally this petition has been filed as Original Application No.3069 of 2003 before the TamilNadu Administrative Tribunal at Chennai and after abolition of TNAT, petition has been transferred and numbered as W.P.No.14238 of 2007. Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the order passed by the respondent in Rc.No.J2/21206/2002 dated 22.09.2002 and set aside the same and direct the respondent to fix the scale of pay of the applicant at Rs.6200/- with effect from 1.7.1996 and confer all the consequential benefits including recovery of Rs.11,414/- recovered from the D.C.R.G.

O R D E R

This Writ Petition has been filed challenging the order passed by the respondent in Rc.No.J2/21206/2002 dated 22.09.2002 and direct the respondent to fix the scale of pay of the applicant at Rs.6200/- with effect from 1.7.1996 and confer all the consequential benefits including recovery of Rs.11,414/- recovered from the D.C.R.G.

2. The learned Additional Government Pleader would submit that he has filed the copy of the death certificate of the petitioner and also submit that the petitioner/deceased's wife is also getting family pension.Further, the legal heirs has not https://hcservices.ecourts.gov.in/hcservices/

taken any steps to implead themselves in the Writ Petition to continue with the same.

3. Since, the petitioner died on 11.10.2013 and sofar no impleading petition has been filed by the legal heirs of the petitioner/deceased, nothing survives in the Writ Petition and the same may be dismissed as abatted.

4.Considering the submission made by the learned Additional Government Pleader, nothing survives for further adjudication in this Writ Petition. Accordingly, this Writ Petition is dismissed as abatted. No costs.
