O R D E R
This Civil Miscellaneous Petition has been filed, seeking to extend the time fixed in the order dated 12.09.2024 passed in C.M.P.No.17457 of 2024 in A.S.SR.No.93677 of 2024 to enable the petitioner to deposit the cost mentioned in the said order. 1/4
2. Learned counsel for the petitioner submitted that C.M.P.No.17457 of 2024 was originally filed for condoning the delay of 109 days in filing the appeal suit. The petition was allowed on 12.09.2024 on payment of cost of Rs.1,000/- to the Tamil Nadu Legal Aid Services Authority, Chennai on or before 25.09.2024, with a rider clause that the petition would stand automatically dismissed in case of non-payment of costs in time. Learned counsel for the petitioner further submitted that since the cost was not paid on or before the expiry date, another petition in C.M.P.No.13587 of 2025 was taken out by the petitioner with a prayer to restore C.M.P.No.17457 of 2024. On 30.07.2025, this Court had allowed the petition, imposing a cost of Rs.500/- payable to the Tamil Nadu Legal Aid Services Authority, Chennai on or before 07.08.2025.

Today, it is represented by the learned counsel for the petitioner that the cost has duly been remitted to the Tamil Nadu State Legal Services Authority, High Court, Madras by the petitioner on 04.08.2025 vide Receipt No.1241. Therefore, it is prayed that present C.M.P.No.20074 of 2025 may be allowed and the time may be extended for payment of cost of Rs.1,000/- 2/4
as ordered by this Court in C.M.P.No.17457 of 2024 dated 12.09.2024. It is further prayed that on payment of cost within the time to be specified by this Court, the appeal suit may be numbered and listed for admission.
4. Learned counsel for the 1st respondent has got no serious objection in allowing this petition and the delay being condoned. There is no representation on behalf of the respondents 2 & 3.

Being satisfied with the reasons assigned in the affidavit filed in support of this petition, this petition is ordered and the time for deposit of cost of Rs.1,000/- (as ordered by this Court in C.M.P.No.17457 of 2024 dated 12.09.2024) is hereby extended till 04.09.2025. The petitioner is directed to pay the costs of Rs.1,000/- (Rupees One Thousand only) to the Tamil Nadu State Legal Services Authority, Chennai, on or before 04.09.2025.
6. On payment of costs, Registry is directed to number the appeal and post it "for admission" on 08.09.2025, if the same is otherwise 3/4
in order. If the cost is not paid on or before 04.09.2025, this C.M.P. stands dismissed automatically without any further reference to this Court. It is made clear that no further extension will be granted at any cost for payment of costs.
