ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.11.2025, for the offences punishable under Sections 8(c), 20(a)(i), 22(c), 25 and 29(1) of NDPS Act, 1985 in Crime No.209 of 2025 registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the petitioner was in possession of 69 grams of Metha Methamphetamine and 500 grams of ganja and the same was seized by the respondent police. Hence this case.

3. The learned counsel for the petitioner submitted that the petitioner was only a driver and he was not aware of the illegal transportation of contraband and he is in judicial custody from 25.11.2025. He further submitted that the petitioner is ready to co-operate with the investigation and prays to grant bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that it is a case of commercial quantity. He further submitted that though it is stated that the petitioner is a driver of the car and he was not aware of the illegal transportation of contraband, he attempted to escape from the scene of occurrence when the police intercepted the car. He further submitted that the quantity involved in this case is commercial in nature and there are two previous cases pending against the petitioner and opposed to grant bail to the petitioner. 2/4

5. I have gone though the F.I.R and the connected records which reveals the fact that the contraband was supplied by the A2 who is a African and quantity involved in this case is commercial quantity .

6. Considering the facts of the case and the quantity involved in this case is commercial quantity and the petitioner has not satisfied twin conditions under section 37 of NDPS Act and there are two previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed . 29.01.2026 smn To
