PRAYER :
Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Declaration, declaring the fixation of date as 01.04.1998 in para 4 of G.O.Ms.No.174 Finance (Pay Cell) Department dated 21.04.1998 for availing gratuity and commutation as illegal, void, ultra virus, insofar as the petitioners are concerned, who had retired before 01.04.1998, and extend all the pensionary benefits to all the petitioners on par with the pensioners who had retired after 01.04.1998 with interest at 18% per annum till the date of actual payment.

ORDER
This Writ Petition has been filed to fix date as 01.04.1998 in para 4 of G.O.Ms.No.174 Finance (Pay Cell) Department dated 21.04.1998 for availing gratuity and commutation as illegal, void, ultra virus, insofar as the petitioners are concerned, who had retired before 01.04.1998, and extend all the pensionary benefits to all the petitioners on par with the pensioners who had retired after 01.04.1998 with interest at 18% per annum till the date of actual payment.
2. Learned counsel appearing for the petitioner would submit that the relief sought for in this writ petition has become infructuous as nothing survives in this writ petition to be adjudicated upon further.
3. Considering the submission made by the learned counsel appearing for the petitioner, nothing survives in this writ petition for further adjudication. Accordingly, the Writ Petition stands dismissed as infructuous. No costs.
