Respondents Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the online bid rejection message dated 12.01.2023 on the file of the 3rd respondent quash the same and direct the respondents to award the work viz. "Construction of Normal Shelter at Kangaran Kuttai in Dharmapuri Municipality" as per tender Notification in Na.Ka. No.2055/2022/E1 dated 16.12.2022 on the file of the 3rd respondent to the petitioner who is the lowest bidder.

O R D E R

This writ petition has been filed challenging the rejection of the bid submitted by the petitioner and for a direction to the respondents to award the work as per the tender notification in favour of the petitioner.

2.Heard Mr.V.Elangovan, learned counsel for the petitioner, Mr.C.Selvaraj, learned Additional Government Pleader for R1, R2 and Mr.L.P.Mourya, learned counsel for R3. 3.The writ petition was filed only on the basis that the petitioner had quoted the lowest amount and inspite of the same, the bid has been given in favour of others who have quoted a higher amount.

3.When the matter was taken up for hearing, it was brought to the notice of this Court that there were two other persons, who have quoted lesser amount than what the petitioner had quoted. In view of the same, the very basis on which this writ petition was filed does not survive.

4.In the result, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
