PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order passed by the respondent in his proceedings Roc No. E2/18203/2016 dated 18.11.2014 and the order passed by the respondent in Memo No.E2/18203/2016 dated 12.07.2016 and quash the same and direct the respondent to revoke the order of suspension passed by the respondent in Roc No.E2/18203/2014 dated 18.11.2014 and to reinstate the petitioner in service. (Prayer amended as per order dated 23.09.2016 in WMP.No.25979 of 2016 in WP.No.12804 of 2016).

ORDER

The order impugned in the present writ petition is an order of suspension, suspending the petitioner from his service.

2. Today, when the matter was called, the learned counsel for the petitioner, on instructions, submitted that the impugned order of suspension was revoked in the month of December, 2016. As such, the prayer sought for has become infructuous.

3. In view of the submission made by the learned counsel for the petitioner, the writ petition stands closed. In case, the subsistence allowances payable to the petitioner during the period of suspension has not been paid, the petitioner is at liberty to make an appropriate representation to the respondent seeking for payment of the subsistence allowances. On receipt of the same, the respondent shall consider it and disburse the subsistence allowance, within period of two (2) weeks from the date of receipt of a copy 2/4

of this order. No costs. Consequently, connected miscellaneous petition is closed.
