Respondents/Respondents PRAYER: Writ Appeal is filed under Clause 15 of the Letters Patent against the order dated 11 September 2012 in W.P.No.27748 of 2011 on the file of this Court.

WP.NO.27748 of 2011:Petition has been filed Under Article 226 of the Constitution of India, Praying for a Writ of Certiorarified Mandamus to Calling for the file in Na.Ka.No.2042/A1/2011 dated 03.11.2011 from the file of the 1st respondent and to quash the same and direct the respondents to reinstate the petitioner as Anganvadi Paniyalar and to order payment of all retirement benefits to the petitioner.

JUDGMENT

(Judgment of the Court was delivered by K.K.SASIDHARAN, J) Heard the learned counsel for the appellant and the learned Special Government Pleader appearing on behalf of the respondents.

2. The writ petition filed by the appellant challenging the order dated 3 November 2011 dismissing her from service as Anganvadi Paniyalar was set aside by the learned Single Judge. The learned Single Judge remanded the matter to the first respondent for passing fresh orders after holding enquiry. The said order is challenged in this intra court appeal primarily on the ground that time was not specified for disposal of enquiry.

3. After hearing the learned counsel for the appellant and the learned Special Government Pleader , we are of the view that interest of justice would be subserved by directing the first respondent to conclude the enquiry as expeditiously as possible.

4. In the result, there shall be a direction to the first respondent to dispose of the enquriy proceedings pursuant to the order dated 11 September 2012 in W.P.No.27748 of 2011 as expeditiously as possible and in any case within a period of two months from the date of receipt of a copy of this judgment.

5. The intra-court appeal is disposed of with the above direction. No costs.
