This Court, by an order dated 03.04.2023 directed the learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram to take the plaint in O.S.SR.No.6836 of 2022 on file and number the same if it is otherwise found to be in order and dispose the suit on merits within a period of three months from the date of receipt of a copy of that order. Since the said case could not be disposed of within the time stipulated by this court, the court below by letter dated 19.07.2023 sought for extension of time. Hence, the matter is listed before this court today.
2. The learned District and Sessions Judge, Kancheepuram submitted that he took charge of District and Sessions Court-II, Kancheepuram on 04.05.2023 and the case was posted for the first hearing on 01.06.2023. Thereafter, on 07.06.2023 written statement was filed and on the same day, issues were framed. However, an Interlocutary Application has been filed for appointment of Advocate Commissioner, which was allowed and the Commissioner was directed to file a report on 04.07.2023 and it was closed on 07.07.2023. Now, the case is posted for trial. Therefore, the court below
was unable to complete the case within the time fixed by this Court. Hence, he prayed to grant further time of two months to dispose the case.

Considering the request of the learned District and Sessions Judge, District and Sessions Court No.II, Kancheepuram, this court is inclined to extend the time for the period of three months from the date of receipt of copy of this order to comply with the order of this court. However, time granted by this court will not be extended after three months. 28.08.2023 rpp
