TERMS OF SETTLEMENT Mr.Kalaiselvan, learned counsel for the respondents submitted that the matter is related to common partition wall and it was settled between the parties and hence nothing survives in the second appeal on the basis of endorsement made by the counsel. Hence, the Second Appeal is disposed of. Consequently connected miscellaneous petition, if any is closed.

2. The full Court fee shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu CourtFees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
