Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Mandamus, forbearing the respondents, their subordinates and agents from blocking the access to the petitioner's house plot No.41 in Pallavan Nagar DTCP Approved Layout in S.No.59/3A3, Kathalampet Village, Vellore Taluk & District, on the northern side of his said house plot by constructing overhead water tank by the 3rd respondent the north south State Highway Road, namely, Singiri Koil to Central Jail Amirthi Road (via) Kathalampet Road comprised in S.No.118 Kathalampet Village, Vellore Taluk & District and pass such further orders.

This writ petition has been filed for issuance of a Writ of Mandamus, forbearing the respondents, their subordinates, and agents from blocking access to the petitioner's house plot No.41 in Pallavan Nagar DTCP Approved Layout in S.No.59/3A3, Kathalampet Village, Vellore Taluk & District, on the northern side of his said house plot by constructing an 2/5

overhead water tank by the 3rd respondent on the north-south State Highway Road, namely, Singiri Koil to Central Jail Amirthi Road (via) Kathalampet Road comprised in S.No.118 Kathalampet Village, Vellore Taluk & District.

2. Learned counsel appearing for the petitioner would submit that the overhead water tank has been constructed in some other place and not in front of the petitioner's house as it was decided earlier by the concerned authorities.
