ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2)of BNS in Crime No.241 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/4
2. The case of the prosecution is that the petitioner had illegally quarried and transported 3 units of river sand by using tipper lorry lorry and JCB. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the nature and gravity of offence, the petitioner had illegally quarried and transported river sand and caused damage to ecology and hence, I am not inclined to grant anticipatory bail to the petitioner. 2/4
