Heard the learned counsel for the petitioner and the learned counsel for the respondents.
2. Today when the matter is taken up for hearing the learned standing counsel for 4th respondent submitted a written instructions of the 4th respondent vide ROC.No.B2/440/2025 dated 14.02.2025. The relevant portion is reproduced hereunder :- "Since the said building was subsequently constructed at New Survey No.88/2 (old Survey No.23-3) Vacant Natham Government Poromboke at an extent of land 0.44.5 sq.metre of Konganamur Village and since it has been also ensured by the 4th respondent not to take up constructed of any kind of Government Buildings in the said Survey No.53/2D of Konganamur Village and only the encroachments made by the petitioner himself by means of 3/7
cultivation of sugarcane crops at the said Survey No.53/2D of PWD Eri Poromboke land need to be evicted by the respondents 9 to 11."
3. In view of the submissions so made by the learned counsel for the 4th respondent that no construction activities has been taken place in the aforesaid survey number.
