Kuppusamy v. Mayakrishnan
CMP.No.1347 of 2023 in S.A.No.166 of 2006 V. LAKSHMINARAYANAN , J.
This is an application to bring on record the legal representatives of the deceased 1st respondent.
2.Notice has been sent to the legal representatives. The 4th and 6th respondents have been served. The 6th respondent has entered appearance through learned counsel Mr.S.Sundareswaran. Ms.S.Vaitheeswari, learned counsel representing Mr.Sundareswaran states that she has no objection to allow the application.
3.I have to point out that being an application to bring on record the legal representatives of the deceased party, it is not necessary to implead all the legal representatives. Even if one legal representative comes on record, he represents the entire estate. In this case, R4 and R6 have been served. They are not opposing the application. Hence, Civil Miscellaneous Petition is ordered.
