(MS) No.165 dated 31.12.2025 under Section 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 and quash the same as being illegal, arbitrary and unconstitutional and issue a consequential direction directing the Respondents their men, agents or any person claiming through them to forbear from acquiring or in any manner interfering with the petitioners peaceful possession and enjoyment of his agricultural land situated in Thiyagavalli Village, Kadalur Taluk, Kadalur District and pass For Petitioner(s):

ORDER

The petitioner states that he is the absolute owner of land bearing Survey No. 28/1 of the extent of 6.62.52 hectares at Thiyagavalli Village, Cuddalore Taluk. According to the petitioner, the respondents have initiated acquisition

proceedings without conducting an environmental impact assessment. After submitting objections on 21.01.2026, the present writ petition has been filed challenging the notification issued under Section 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997.

2. Mr.P. Sathish, learned Additional Government Pleader, accepts notice for respondents 1 to 6 and Mr.Abishek Murthy, learned standing counsel, accepts notice for the 7th respondent.

3. Both of them submit that the petitioner has raised objections and that such objections would be considered and orders would be issued under Section 3(1) of the above mentioned enactment. Mr.Abishek Murthy adds that environmental clearance is not necessary at this stage.

4. The documents on record reflect that the matter is at the stage of issuance of notice under Section 3(2). The petitioner has raised objections, including with reference to not conducting the environmental impact assessment. Upon consideration thereof, the third respondent shall pass orders after providing a reasonable opportunity to the petitioner.

5. Accordingly, this writ petition is disposed of directing the third respondent to consider the objections dated 21.01.2026 of the petitioner and to

pass a speaking order thereon within a period of two months from the date of receipt of a copy of this order. Consequently, connected miscellaneous petitions are closed. No costs.
