21st April 2006 issued by the second respondent, and quash the notification dated 21.4.2006 and consequently direct the first respondent to invoke the provisions of Coal Bearing Act and direct the payment of compensation for the lands acquired in terms of the said Act.

The learned counsel appearing for the petitioner would submit that the present case is already covered by the decision of this court and hence prays to close this writ petition. He has also made an endorsement to that effect in the affidavit filed in support of this writ petition.

2. In view of the endorsement made by the learned counsel for the petitioner, nothing survives in the present writ petition and therefore no further adjudication is required.

3. Accordingly, the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
