O R D E R

Apprehending arrest in connection with Crime No.10 of 2025 registered for the offences punishable under Section 24 (1) of Cigarette and other Tobacco Products Acts, 2003 and under Section 123 of BNS, 2023, the present petition has been filed seeking anticipatory bail. 2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3.The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner along with other accused was Page No.2 of 4

found to be in illegal possession of Hans - 4 packets, Cool lips 7 packets, tobacco, 50 bundle Hans ( one bundle contained 15 Hans) from each 7 Nylon bags which totally to 5250 Hans. He further submitted that, apart from this case, petitioner has seven previous cases of similar in nature pending against the petitioner and therefore, the custodial interrogation of the petitioner is very much required.

4. Considering the gravity of the offence committed by the petitioner and also the fact that the petitioner has got seven previous cases which are of similar in nature pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
