O R D E R

This writ petition has been filed for the following relief: "To issue a writ of Mandamus, directing the 2nd respondent to issue No Objection Certificate as per the communication made by the 1st respondent dated 08.12.2025 and consequently directing the 1st respondent to provide the Electricity Service Connection to the petitioner's house in Door No.16D, ST-1, West Street, Sirumugai Village, Mettupalayam Taluk, Coimbatore 641 302 in S.G.No.108/B, by accepting the indemnity bond in Form-6 as per the Clause 27(12) of the Tamil Nadu Electricity Distribution Code as amended upto 31.03.2024."

2. The petitioner is residing in the subject property along with her joint family for more than 35 years by constructing a cement sheet house situated at Door No.16D, ST-1, SF No.108/B, Sirumugai Village, Mettupalayam Taluk, Coimbatore District. The petitioner has been in 2/6

continuous possession and enjoyment of the property and has been paying all statutory dues, including property tax and kist, which stood in the name of her husband's brother, Nagappa Gounder, who died intestate.

3. In January 2025, the petitioner applied to the 1st respondent for grant of domestic electricity service connection under Tariff-I(A), Single Phase, along with all required documents. Thereafter, the Village Administrative Officer and Revenue Inspector conducted a personal inspection and recommended issuance of a "No Objection Certificate" (NOC) to the Tahsildar, Mettupalayam, vide communications dated 28.02.2025 and 06.03.2025 respectively. Despite the above, no action was taken by the 1st respondent. Hence, the petitioner again submitted a representation on 05.11.2025 at the Chief Minister's Special Camp. The petitioner was thereafter informed that an NOC from the PWD is required, as the land is stated to be under PWD control. However, the respondents have been reluctant to process the request on that ground.

The petitioner is willing to give an undertaking as per TANGEDCO norms and will not claim any right over the land. There is no legal impediment under Clause 27(12) of the Tamil Nadu Electricity Distribution Code for grant of electricity connection. By communication dated 08.12.2025, the 1st respondent informed the 2nd respondent about the petitioner's application and issuance of NOC, but no further steps have been taken. Hence, the petitioner is before this Court.

4. The learned Special Government Pleader appearing for the respondents would submit that the petitioner has not made an application to the 2nd respondent for issuance of "No Objection Certificate". However, the learned counsel for the petitioner would argue that since the application 3/6

has been submitted at the Chief Minister's Special Camp held at Muthusamy Mahal on 05.11.2025, there was no necessity to issue a separate application for issuance of "No Objection Certificate".

5. Heard the learned counsels on both sides and perused the materials available on record.

A perusal of the communication sent by the first respondent to the second respondent would reveal that the electricity service connection can be granted only upon receipt of a "No Objection Certificate". Therefore, the petitioner's contention that the mere filing of an application at the Chief Minister's Special Camp would automatically confer upon her a right to the issuance of "No Objection Certificate" is absolutely baseless. The Petitioner has to make necessary application to the 2nd respondent for grant of "No Objection Certificate" and without any application the petitioner cannot seek "No Objection Certificate". Therefore the Writ Petition is dismissed. No costs.
