The petitioner who was arrested and remanded to judicial custody on 28.11.2022 for the alleged offence punishable under Sections 166,167,420,465,467,468,408,471,409 and 120(B) in C.R.No.01 of 2022 seeks bail.

2. The case of the prosecution is that the petitioner who is a Government servant colluded with other accused and failed to implement the Government scheme and had also not gave incentives to the farmers and thereby swindled the Government money to the tune of Rs.315 crores. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is not the authorized persons to handle the Government funds and he is only a Village Administrative officer and his only duty is to give Adangal register to the farmers and he has not committed any offence as

alleged by the prosecution and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence prays for grant of bail.

4.The learned Government Advocate (Crl.Side) would submit that totally 30 accused had been involved in this case and the petitioner herein arrayed as A8. He would submit that there was a scam in civil supplies department and A1 to A11 are officials of Civil supplies Corporation. He further submits that the petitioner has issued fake Adangal certificate and he has been suspended from his services and the investigation is still pending. He further submits that this is the third bail application and earlier bail application has been dismissed. Hence he vehemently opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and the that there is a possibility of tampering the witnesses and this Court had earlier dismissed two bail applications filed by the petitioner and there is no change in circumstances, this court is not inclined to grant bail to the

petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 16.02.2023 smn
