Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Declaration, declaring that the Government Order issued by the first respondent in G.O.(Ms).No.66 Home (Pol.2) Department dated 12.01.2007 deleting rule 4(B) of the T.N. Police Service retrospectively from 01.06.2006 as null and void and further direct the respondents to consider the claim of the petitioners for promotion as Deputy Superintendent of Police, Category-I for the ensuing panel of the year 2006-07 and grant such other further relief as this Hon'ble Court may deem fit. When the matter was taken up for hearing, the learned Special Government Pleader would submit that in view of the findings of this Court dated 20.9.2007, made in WP.Nos.7856 & 10101 to 10103 of 2007, the Rules have been amended even prior to the filing of the present Writ Petition and a copy of the proceedings has also been produced before this Court. Therefore, nothing survives to further adjudicate in the Writ petition. Hence, this Writ Petition may be dismissed as infructuous. 2.Recording, the submissions made by the learned counsel for the petitioner, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
