O R D E R

The petitioners, who were arrested and remanded to judicial custody on 28.12.2025 for the alleged offence under Sections 318(4) of BNS @ 61, 11(2) and 318(4) of BNS in Crime No.399 of 2025 on the file of the respondent police, seeks bail.

The allegations against the petitioners are that the petitioners herein, joining hands with other accused, were involved in pledging spurious gold and, along with the same, produced a fabricated Aadhaar Card and obtained a gold loan of Rs.1,90,000/-. Subsequently, it was revealed that the petitioners had cheated the defacto complainant, which led to the registration of an FIR and the arrest of the petitioners. Hence, the present case.

The learned counsel appearing for the petitioners submitted that the petitioners have been in custody since 28.12.2025 and that based on the complaint lodged against the petitioners, some other complaints were also lodged and all were registered on the same day. He further submitted that the petitioners are ready to cooperate with the investigation and are willing to abide by any stringent conditions imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police opposed the bail petition, reiterated the prosecution 2/4

case, and submitted that after the arrest of the petitioners, it was revealed that five complaints have been received and the total amount involved is Rs.8,50,000/-. He further submitted that only 28 grams of gold has been recovered so far. Hence, he opposed the grant of bail.

5. Heard both sides and perused the materials available on record.

Considering the nature of the allegations, the fact that the petitioners were involved in a series of offences, that all the complaints were registered immediately after their arrest, and that the entire property has not yet been recovered. Hence, I am not inclined to grant bail to the petitioners at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 23.01.2026 Vv To
