Prayer : The Second Appeal is filed under Section 100 of C.P.C. against the Judgment and Decree dated 28.10.2009 passed in A.S.No.11 of 2009 on the file of the Principal District Judge, Cuddalore reversing the judgment and decree dated 30.09.2008 passed in O.S.No.127 of 2007 on the file of the First Additional Subordinate Judge, Cuddalore.

JUDGMENT

Today, when this appeal came up for hearing, the learned counsel for the appellant appeared before this Court and sought further accommodation for arguing the matter.

2. On going through the order sheet dated 01.12.2021, it appears that this Court, after considering the year, on which, the appeal has been filed, ordered fresh Notice to the respondent through Court as well as privately, returnable by 22.12.2021. Even after knowing the same, till date, the learned counsel for the appellant did not take any steps for sending notice to the respondent through Court as well as privately.

3. In view of the same, this Second Appeal is dismissed for default. No costs.
