2. Heard learned counsel for petitioners.

3. Notice to first respondent is dispensed with since the first respondent remained ex parte before the Tribunal.

4. Mr.S.S.Sajeev Kesan, learned counsel, takes notice for second respondent.

5. Satisfied with the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and the delay of 94 days in preferring the above appeal is condoned.

Registry is directed to number the appeal, if it is otherwise in order and post it for admission in due course. Registry is also directed to print the name of Mr.S.S.Sajeev Kesan, learned counsel for second respondent at the time of admission.
