..Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of mandamus directing the 2nd respondent to conduct a detailed enquiry as contemplated under section 63(d) read with section 6(19) of Hindu Religious and Charitable Endowments Act, 1959 as directed by the first respondent in his order dated 15.06.2010 in

O R D E R

Writ Petition has been filed seeking a direction to the 2nd respondent to conduct a detailed enquiry as contemplated under section 63(d) read with section 6(19) of Hindu Religious and Charitable Endowments Act, 1959 as directed by the first respondent in his order dated 15.06.2010 in R.P.No.37/2004/D2.

2. Despite the matter has been remitted by the Commissioner, to conduct an enquiry afresh and pass orders on merits, for the past 13 years the enquiry is pending without any progress. Hence seeks a direction.

3. Mr.N.R.R.Arun Natrajana, Learned Special Government Pleader, takes notice on behalf of the respondents 1 and 2 and submits that still the enquiry is pending and they will complete the same. Further submitted that the parties are not co-operating.

4. In such view of the matter, the Joint Commissioner is directed to issue notice to all the parties and conclude the enquiry within a period of four months from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
