Mr.K.Raja COMMON ORDER These Writ Petitions have been filed to direct the respondents to pay interest for the belated payment of terminal benefits such as Gratuity, Provident Fund, Earned Leave Salary amounts, and other unsettled benefits of difference amounts of pension arrears, Gratuity and Earned Leave Salary to the petitioners.
2. Mr.K.Raja, learned counsel takes notice for the respondents. In view of the consent expressed by the learned counsel on either side, these Writ Petitions are taken up for final disposal at the stage of admission itself. __________Page 4 of 8
3. It is the case of the petitioners that the petitioners, who had joined the services of the respondent Corporation, had already retired from service, however, the terminal benefits were settled belatedly, and the remaining retirement benefits have not been disbursed till date. Therefore, the petitioners seek payment of interest on the belated settlement of terminal benefits and a direction to disburse the unsettled retirement benefits. In this regard, they have also made representations before the respondent, which have not been evoked any response so far. Hence, the petitioners are before this Court.
4. Heard the learned counsels appearing on either side and perused the materials available on record.

In view of the limited request made by the petitioners with regard to interest on the belated payment of terminal benefits, this Court directs the respondent to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.
6. Insofar as the unsettled retirement benefits are concerned, this Court directs the petitioners to make a fresh representation before the respondent, __________Page 5 of 8
along with a copy of this order, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the said representations, the respondent shall consider the same on merits and pass appropriate orders in accordance with law within a period of four (4) weeks thereafter, after affording an opportunity of hearing to the petitioners and any other interested parties.
7. Accordingly, these Writ Petitions are disposed of. There shall be no order as to costs.
