This case is taken up through video conference. 2.

This criminal original petition has been filed seeking to call for the records in C.C.No.3426 of 2014 on the file of the XXIII Metropolitan Magistrate Court, Saidapet, Chennai and quash the same.

The respondent initiated a prosecution in C.C.No.3426 of 2014 before the XXIII Metropolitan Magistrate Court, Saidapet, Chennai, against the petitioners herein, for the offences under Sections 499 and 500 IPC, for quashing which, the petitioners have preferred the present petition under Section 482 Cr.P.C.

Today, when the matter was taken up for hearing, the learned counsel on both sides submitted that they have entered into an amicable settlement and filed a joint memorandum dated 02.11.2020, which reads as under:

"The Respondent filed a private criminal complaint against the petitioners for the alleged offences u/s 499 and 500 IPC.

The complaint was taken on file in C.C.No.3426 of 2014 on the file of the XXIII MM, Saidapet, Chennai - 15.

The petitioners moved the quash petition before this Hon'ble Court in Crl.O.P.No.8173 of 2015.

The parties decided to compromise the issue and entered into a compromise.

Pursuant to the compromise the Respondent is not going to proceed with the case and has got no objections to quash C.C.No.3426 of 2014 pending on the file of the XXIII MM, Saidapet, Chennai -15.

The parties therefore humbly pray that this Hon'ble Court may be pleased to record the memo and quash the proceedings in C.C.No.3426 of 2014 pending on the file of the XXIII MM, Saidapet, Chennai - 15."

In view of the above, this criminal original petition is allowed and the proceedings in C.C.No.3426 of 2014 on the file of the XXIII Metropolitan Magistrate Court, Saidapet, Chennai, is hereby quashed. Connected Crl.M.Ps. are closed. -s/d- Assistant Registrar True Copy Sub-Assistant Registrar nsd
