ORDER

The case has been heard through video conference The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 77 of The Juvenile Justice (Care and Protection of Children) Act. 2015 r/w Section 6 and 24(1) of Cigarette and Tobacco Products Act, 2003 in Crime No.1243 of 2020, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 65 packets tobacco products and they had sold the hans to the school boys. Hence, the complaint was registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that based on the confession of A2 and A3, he was falsely implicated in this case. He would further submit that there is no previous case pending as against the petitioner. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor submits that the petitioner along with other accused persons were found in illegal possession of 65 packets tobacco products and they had sold the hans to the school boys. arrested and the confession of co-accused, this petitioner was implicated in this case. Hence he vehemently opposed to grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and that the petitioner has involved in very serious offence, this Court is not inclined to grant anticipatory bail to the petitioner.
