Originally this petition has been filed as Original Application No.2647 of 2003 before the Tamil Nadu Administrative Tribunal at Chennai and after abolition of TNAT, application has been transferred and numbered as W.P.No.16794 of 2007. Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records relating to the proceedings of the second respondent dated 30.09.2002 in Na.Ka.No.139295/ W26/92, quash the same and consequently for a direction, directing the respondents to regularize the service of the petitioner as vocational instructor Grade I with effect from 23.09.1994 and give all the concomitant monetary and other service benefits on par with other vocational instructors Grade I.

ORDER

This Writ Petition has been filed challenging the proceedings in Na.Ka.No.139295/W26/92 of the second respondent dated 30.09.2002, quash the same and consequently to direct the respondents to regularize the service of the petitioner as vocational instructor Grade I with effect from 23.09.1994 and give all the concomitant monetary and other service benefits on par with other vocational instructors Grade I.

2. When the matter came up on earlier occasion, learned Additional Government Pleader appearing for the respondents submitted that the relief sought for in the writ petition has been complied with and therefore, nothing survives in the writ petition. However, the learned counsel appearing for the petitioner sought time to get instructions from his client. Hence, the matter was posted for today. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner.

3. Recording the submission made by the learned Additional Government Pleader appearing for the first and second respondents that the relief sought for in this writ petition has been granted and nothing survives in this writ petition for further adjudication, this Writ Petition is dismissed as infructuous. No costs.
