(R2 is suo-motu impleaded vide order dt.02.02.26) ..Respondent(s) Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondent herein to correct the error occurred in the FMB and other revenue records including Patta, Chitta and A Register as per the sale deed, settlement deed and partition deed dated 09.03.1992 regarding the property comprised in at S.F No.50/1 and 50/2 at Panaimadal Village, Pethanaickenpalayam Taluk, Salem District and by considering the representations of the petitioner herein dated 17.11.2025 and 09.12.2025 within a reasonable time as fixed by this court. ORDER

The petitioner seeks for correction of FMB and other revenue records in this writ petition. The competent authority to adjudicate the same is District Revenue Officer. Since the District Revenue Officer is not arrayed as party respondent, this Court suo-motu impleads the District Revenue Officer, Salem, as party second respondent in this writ petition. Registry is directed to carry out necessary amendment in the cause title.

2. This writ petition has been filed seeking for correction of FMB and other revenue records for the property morefully described in the prayer to this writ petition, based on the petitioner's representations dated 17.11.2025 and 09.12.2025, within a time frame to be fixed by this Court.

3. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents.

4. No prejudice will be caused to the respondents if the aforesaid representation of the petitioner is considered on merits and in accordance with law, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:-

(a) Since the petitioner has given a representation only to the first respondent, who is not the competent authority, the petitioner will have to give a fresh representation to the second respondent requesting correction in FMB and other revenue records for the subject property, within a period of one week from the date of receipt of a copy of this order. (b) On receipt of the said representation, the second respondent shall pass final orders, on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner, within a period of 12 weeks thereafter.

(c) This Court is not expressing any opinion on the merits of the fresh representation to be submitted by the petitioner with the second respondent.
