ORDER : The Court Made the following order :- The petitioner is A1. Apprehending arrest at the hands of the respondent police for the alleged offence under Section4(1)(aa) and 4(1-A) of the Tamil Nadu Prohibition Act in Crime No.38 of 2021 on the file of the respondent police, the petitioner seeks anticipatory bail.

2. The case of the prosecution is that when the respondent police were in patrol duty they found the petitioner was in possession of 60 liters of arrack. On enquiry they came to know that the petitioner was also selling Arrack. Hence, the respondent police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner was in possession of 60 liters of arrack. He further submitted that the petitioner is a habitual offender and there are two previous cases pending against the petitioner. Hence, he prays for dismissal of this petition.

5. Considering the fact that the petitioner was involved in serious offences and the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
