Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the order dated 25.04.2015 issued by the second respondent in Letter No.SE/O/NCTPS/EA/F.Spn.75/D309/15, quash the same and consequently direct the respondents 1 and 2 to accept the petitioner tender which he has made pursuant to the tender notification in Specification No.SE/O/NCTPS/75/2014-15 and allow him to participate in the said tender process and finalise the same in accordance with law and to award contract/work order to the person who have given lowest price and award costs.

O R D E R

The impugned order dated 25.04.2015, issued by the second respondent, rejecting the tender submitted by the petitioner, is under challenge in the present writ petition. However, the tender period itself was expired and therefore, no relief needs to be granted.

However, the learned counsel for the petitioner states that the other informations relating to the grant of tender is to be furnished to the petitioner as per the provisions of the Tender Transparency Act. Thus, the petitioner is at liberty to submit a fresh application, seeking any other information relating to the tender and in the event of submitting any such application, the respondents shall consider the same and provide information to the petitioner.

3. With the above observations, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
