Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to pay increment as per G.O.Ms.No.311 Finance (CMPC) Department dated 31.12.2014 with effect from 01.01.1995 with all arrears based on the petitioner's representation dated 03.03.2015 followed by another representation dated 12.03.2016 with all monetary and other attendant benefits. ORDER
The petitioner, aged about 80 years, has come to this Court seeking issuance of a writ of mandamus, directing the respondents to pay increment as per G.O.Ms.No.311, Finance (CMPC) Department dated 31.12.2014 with effect from 1.1.1995, on the basis of his representation dated 12.03.2016 with all monetary and other attendant benefits.
2. The petitioner, after serving as Extension Officer (Panchayats) of Vallam Panchayat Union, Villupuram District, retired from service on reaching the age of superannuation on 31.12.94, one day prior to his date of increment, which fell due on 1.1.95. Therefore, he gave a representation on 3.3.2015 relying upon G.O.Ms.No.311, Finance (CMPC) Department dated 31.12.2014 followed by another representation on 12.3.2016. But the same having gone into deaf ears, the petitioner has come to this Court seeking for disposal of his representations in the light of the aforementioned Government Order.
3. Mr.V.Jayaprakash Narayanan, learned Special Government Pleader for the respondents 1 to 3 sought some reasonable time to dispose of the pending representations of the petitioner.
4. This Court, considering the fact that the petitioner is aged about 80 years, hereby directs the first respondent to consider and dispose of the pending representations of the petitioner, in the light of G.O.Ms.No.311, Finance (CMPC) Department dated 31.12.2014, within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
