Mr.A.Damodaran, learned Additional Public Prosecutor takes notice on behalf of the 1st respondent.

2.Notice to the 2nd respondent, returnable in four weeks. Private Notice is also permitted.

3.The case of the prosecution is that the defacto complainant had approached A1 and A2 for supply of granite. He is said to have made payment to the tune of Rs.67,75,500/- during the period between 2010 to 2014. Thereafter, it is contended that the amount was not repaid back and when he demanded for the amount, he was also threatened with dire consequences. The petitioner happens to be the son of A1 and on going through the FIR, this Court does not find any prima facie materials against the petitioner (A3).

4.In view of the above, the investigation shall go on and filing of the final report shall await further orders of this Court. https://www.mhc.tn.gov.in/judis
