JUDGMENT

For the convenient sake, the parties may be referred to as the complainant and the accused.

The present appeal has been filed challenging the order of acquittal of the accused passed by the Judicial Magistrate Court No.III, Salem in S.T.C.No.968/2011 dated 20.12.2013 for the offence punishable under Sec.138 of Negotiable Instruments Act.

3. Notice was not served on the accused and heard the learned counsel for the complainant.

In view of the judgment of Full Bench of this Court in the case of S. Ganapathy vs N. Senthilvel reported in (2016) 3 MLJ (Crl) 641 (FB), Registry is directed to send the records to the Court of Principal District and Sessions Judge, Salem after taking photocopy of the file, within a period of four weeks from the date of receipt of a copy of this Order.

The complainant is directed to appear before the learned Principal District and Sessions Judge, Salem on 27.11.2017.
