ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.11.2025, for the offences punishable under Sections 126(2), 296(b), 309(4), 311,351(3) of BNS in Crime No.1073 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and robbed a sum of Rs.1850/- at knife point and also threatened him with dire consequences. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he is in judicial custody from 16.11.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner is a history sheeted person and there are 13 previous cases pending against the petitioner. Hence, opposed to grant bail to the petitioner. 2/4

5.Considering the facts, gravity of offence and there are 13 previous cases pending against the petitioner which are similar in nature and if the petitioner is released on bail he will attempt to tamper the evidence, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition stands dismissed. 22.01.2026 smn To
