This writ petition has been filed for issue of writ of mandamus directing the 1st respondent to deal with the representation made by the petitioner on 19.10.2022, wherein, the petitioner has sought for adding his name as one of the joint patta holder with respect to the subject property.
2.Heard Mr.D.Bharathy, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of respondents.
3.The case of the petitioner is that the subject property was originally owned by the father of the petitioner and the patta also stood in his name. The father expired during the year 2014 leaving behind his wife, three sons and one daughter. The grievance of the petitioner is that one of the son managed to get the patta exclusively in his name. Subsequently, the mother of the petitioner expired in the year 2022 and one of the sister also died in the year 2024. Therefore, the petitioner contends that the patta should stand in the name of the three sons and whereas, it stood in the name of one of the son. Hence, the representation was made in this 2/4
regard and since the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions. 4.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 1st respondent to deal with the representation made by the petitioner on 19.10.2022 on its own merits and in accordance with law after affording opportunity to all the interested parties and final orders shall be passed, within a period of six weeks from the date of receipt of copy of this order.
