ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 14.09.2021 for the offence under Section 392 read with 34 IPC in Crime No.78 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused came in a two wheeler and committed theft of defacto complainant's mobile phone. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner has been suffering incarceration for more than 125 days from 14.09.2021. Hence, he pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner has got 24 previous cases and if he is released on bail, there is every possibility of the petitioner getting abscond and tampering the evidence.

5. At this juncture, the learned Counsel for the petitioner would submit that the petitioner was initially arrested in Crime No.210 of 2021 and subsequently implicated in 14 cases and arrested through P.T. Warrant and that he is no way connected with those offences.

6. On seeing the nature of allegations levelled against the petitioner and his antecedents and if he is released on bail, there is every possibility of him getting abscond and tampering the evidence. Therefore, this Court is not inclined to grant bail to the petitioner.
