Respondent PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the learned II Additional Family Court, Chennai, for speedy disposal of H.M.O.P.No.459 of 2014 pending on its file.

ORDER

This Civil Revision Petition has been filed seeking a direction to the learned II Additional Family Court, Chennai, to dispose H.M.O.P.No.459 of 2014, within a stipulated period of time.

2. The petitioner is the husband and respondent is the wife. The petitioner filed H.M.O.P.No.459 of 2014 on the file of the Family Court, Chennai, for divorce against the respondent on 10.02.2014. The respondent has filed counter on 07.08.2015. The petitioner filed proof affidavit in the month of November, 2015. The petitioner was not cross-examined by the respondent till date and the case is kept pending, without any progress. In such circumstances, the petitioner has come out with the present petition, for early disposal of the H.M.O.P.No.459 of 2014.

3. Heard the learned counsel appearing for the petitioner.

4. Having regard to the submissions made by the learned counsel for the petitioner, considering the limited prayer sought for in the civil revision petition and since the H.M.O.P. is pending from the year 2014, without expressing any opinion with regard to the merits of the matter, I direct the learned Judge, II Additional Family Court, Chennai, to dispose H.M.O.P.No.459 of 2014, on merits and in accordance with law, as expeditiously as possible, in any event, not later than 30th September 2017.

5. The Civil Revision Petition is disposed of with the above direction. No costs.
