The petitioner who was arrested and remanded to judicial custody on 08.07.2023 for the offences punishable under Sections 5(l), 5(j)(ii), 6 of Protection of Children from Sexual Offences Act, 2012 in crime No.10 of 2023 on the file of the respondent Police, seeks bail.

2. The petitioner is aged 44 years and the victim child is aged 14 years. The petitioner is the paternal uncle of the victim. Then naturally, he is in a position to exercise undue influence over the victim. The victim had been impregnated and the fetus has also been aborted after five months. 3.The respondent had completed their investigation and filed the final report which had been taken cognizance as Spl.S.C.No.36 of 2023 before the learned Sessions Judge, Fast Tract Mahila Court, Tiruvarur District.

4.Taking into consideration that the protection will have to be give to the victim who is vulnerable and since the accused is her own paternal uncle, I am not inclined to grant bail to the petitioner. 5.Hence, this Criminal Original Petition is dismissed. 02.02.2024 vkr https://www.mhc.tn.gov.in/judis
