ORDER

The petitioner/A2, who was arrested and remanded to judicial custody on 18.12.2025 for the alleged offence under Section 8(c), 20(b)(ii)(A), 22(b) & 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.764 of 2025 on the file of the respondent police, seeks bail.

The allegation against the petitioner is that the petitioner along with other accused were in illegal possession and transportation of tally 5 grams of Methamphetamine and 500 grams of ganja and the same was seized and the petitioner was arrested and remanded to judicial custody on 18.11.2025. Hence, the case has been registered.

3. The learned counsel appearing for the petitioners would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and submitted that totally there are three accused in this case and the petitioner is ranked as A2 and he is a college student. He further submitted that it is not a case of commercial quantity and also he was arrested only recently and no previous bad antecedents have been registered against him. However, he opposed to grant bail to the petitioner.

5. Considering the nature of allegations leveled against him; and also the fact that it is not a case of commercial quantity; and no previous bad

antecedents have been registered against him, and also considering the period of incarceration undergone by the petitioner and that the co-accused has already been granted bail by this Court in Crl.O.P.No.711 of 2026 dated 09.01.2026, this Court is inclined to grant bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned II Metropolitan Magistrate Court, Egmore, Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the respondent police daily at 06.30 p.m., for a period of four weeks and thereafter, as and when required for interrogation; [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
