C O M M O N J U D G M E N T (The matter is heard through Video-conferencing/Hybrid mode) These Civil Miscellaneous Second Appeals have been filed against the judgment and decree dated 30.08.2010 made in C.M.A.Nos.6 and 7 of 2009 on the file of the Sub Court, Perambalur, confirming the fair and decretal order dated 06.09.2007 made in E.A.Nos.199 and 228 of 2005 in E.P.Nos.18 and 14 of 2005 in O.S.Nos.204 and 209 of 2004 on the file of the District Munsif Court, Perambalur.

2.Today, when the matters are taken up for hearing, the learned counsel appearing for the 1st respondent in both the cases submitted that the 1st respondent in both the cases, who are decree holders, filed E.P.Nos.18 and 14 of 2005 in O.S.Nos.204 and 209 of 2004 on the file of the District Munsif Court, Perambalur and on transfer, the said E.P.Nos.18 and 14 of 2005 are re-numbered as E.P.Nos.1 and 2 of 2021 on the file of the District Munsif Court, Kunnam, Perambalur District. The learned counsel further submitted that the appellants have paid a sum of Rs.3,20,000/- (Rupees Three lakhs twenty thousand only) to the 1st respondent in both the cases in E.P.Nos.1 and 2 of 2021 in O.S.Nos.204 and 209 of 2004 and therefore, the 1st respondent in both the cases will not press E.P.Nos.1 and 2 of 2021 in O.S.Nos.204 and 209 of 2004 on the file of the District Munsif Court, Kunnam, Perambalur District.
