The petitioners, who are arrayed as A-1,A2 & A-3, were arrested and remanded to judicial custody on 10.03.2016 for the alleged offences punishable under Sections 341,354-A,506 (i) of IPC r/w section 11 and 12 of the POSCO ACT-2012 and Sec.3(1)(x),3(1)(s),3(1)(w)(ii) of SC&ST (POA) Act, Amendment Ordinance 2014 in Crime No.85 of 2016 on the file of the respondent police and hence, seek bail.

2.The case of the prosecution is that there was a wordy quarrel between the petitioners and the de facto complainant and the petitioners abused the defacto complainant with filthy language, resulting in the registration of the case.

3.Learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated as accused in the present case.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that on completion of investigation, charge sheet has been filed before the Judicial Magistrate No.II, Mayliaduthurai and the same was taken on file as PRC.No.13 of 2016.

mrp/nvi 5.Considering the facts and circumstances of the case and also considering the fact that the investigation has been over and charge sheet has already been filed in PRC.No.13 of 2016, this Court is inclined to grant bail to the petitioners with certain conditions.

6.Accordingly, the petitioners are ordered to be released on bail on their executing a personal bond for a sum of Rs.10,000/- [Rupees Ten Thousand only] with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate II, Mayiladuthurai, and on further condition that the petitioners shall report before the concerned Court on all working days at 10.30 a.m. until further orders.
