ORDER

The petitioner has filed this Writ Petition praying for issuance of a Writ of Mandamus to direct the second respondent for transfer of patta to the petitioner's name in respect of house site measuring about 1309 Sq.Ft. comprised in S.F.No.103/7 (Old S.No.103/2 part) at Bangaram Village, Kallakurichi Taluk, Villupuram District, as stated in the petitioner's representation, dated 19.10.2015.

It is the case of the petitioner that he purchased a piece of residential site, vide Document No.5074/2012 on the file of Chinna Salem SRO, measuring about 1309 Sq.F. in the said survey number and place, for a valuable consideration and he is in possession; his vendor purchased the said property, vide, sale deed document No.2995/2011. The petitioner sent a representation, dated 19.10.2015 to the second respondent for grant of patta in his name in respect of the said house site, by https://hcservices.ecourts.gov.in/hcservices/

enclosing necessary documents. The first respondent has also received the said representation. Since no action is taken by the respondents, the petitioner has filed this Writ Petition for the above relief.

3. Heard both sides.

4. Considering the above facts and circumstances of the case and without going into the merits or otherwise of the case, this Court directs the second respondent to consider the said representation of the petitioner, dated 19.10.2015, conduct enquiry and give an opportunity of personal hearing to the petitioner and other necessary parties and thereafter pass appropriate orders and dispose of the said representation, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and it is for the second respondent to decide the same.

5. With the above observations and directions, the Writ Petition is disposed of. No costs.
