By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to pay interest at the rate of 8% per annum on the delayed payment of the commuted pension amount of Rs.4,84,279/- for the period from 30.06.2017 to 30.01.2021 (43 months) within a time frame as may be fixed by this Court.
3.The learned counsel appearing for the petitioner submitted that the petitioner who had joined the services of the respondent Corporation, had retired from service on 30.06.2017, however, the terminal benefits have been settled only on 30.01.2021. Therefore, the petitioner claimed 10% interest on the belated payment of terminal benefits and made representation to the respondents to pay interest 2/4
for the belated payment of terminal benefits, however, there is no response.
4.In view of the limited request made by the petitioner with regard to interest on the belated payment of terminal benefits, this Court directs the respondents to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order. 5.Accordingly, this writ petition is disposed of.
