Prayer : Petitions filed under Article 226 of the Constitution of India, to direct the respondents to regularise the services of the applicant in the post of Water Supply Attender with effect from the date of his initial appointment in the year 1982 and fix his pay in the Time Scale of Pay applicable to Water Supply Attenders under the 5th pay Commission and 6th Pay Commission Scales of Pay and grant him all consequential benefits.

Today when the matter is taken up for hearing, there is no representation for the petitioner.
2.The learned Special Government Pleader would submit that while this Writ Petition is pending, the petitioner had also approached the Madurai Bench of this Court in W.P.(MD).No.31 of 2009 wherein, a direction was also given to the third respondent therein, vide order dated 28.01.2009 and subsequently, the https://hcservices.ecourts.gov.in/hcservices/
petitioner died on 12.10.2018.
3.Therefore, the relief sought for in this writ petition has become infructuous and hence, there is nothing survives for adjudication in this writ petition. Accordingly, the Writ Petition is dismissed as infructuous.
